Terms of Service
Last updated 23 October 2026
These terms are an agreement between you and Herantes (“we”, “us”), the operator of Nilav at nilav.art. By creating an account or using the service you agree to them. If you use Nilav for a company, you agree on its behalf and confirm you are allowed to.
1. The service
Nilav generates content with artificial intelligence: scripts, captions, blog posts, images, voiceovers and narrated explainer videos. Generation runs on third-party AI models (currently OpenAI). We may add, change or remove features; if we remove something central to a paid plan we will tell you in advance.
2. Accounts
- You must be at least 18, or the age of majority where you live, to create an account.
- Give accurate details and keep your password safe. You are responsible for activity on your account.
3. Plans, billing and credits
- Paid plans are subscriptions billed monthly or yearly in advance, in Indian rupees or US dollars, through Razorpay. Prices are shown on our pricing page before you pay and include applicable taxes for Indian customers.
- Subscriptions renew automatically at the end of each period using the payment method you authorised, until you cancel. Razorpay notifies you before each renewal charge.
- Each plan grants a credit allowance per billing month (a yearly plan grants twelve months of allowance when it is paid). Generations cost credits as shown in the app. Plan credits reset at each renewal and do not roll over.
- Top-ups are one-time purchases for subscribers. Their credits are used after your plan credits and are valid for 12 months.
- Credits have no cash value, cannot be transferred and are not refundable except as our refund policy says.
- If a renewal payment fails, Razorpay retries it for a few days. If it still fails, the subscription ends and your plan’s credits are removed; top-up credits stay until they expire.
- We may change prices for future billing periods. We will email you at least 14 days before a price change applies to your subscription, and you can cancel before it does.
- Cancellation and refunds are covered by our Cancellation & Refund Policy.
4. Your content and what you make
- You keep ownership of what you upload or type in (“inputs”).
- As between you and us, you own what Nilav generates for you (“outputs”), to the extent the law allows ownership of AI-generated material. Similar outputs may be generated for other people.
- The Pro and Studio plans include use of outputs for commercial purposes, including client work and monetised channels. Creator is for personal and non-commercial use.
- You give us the permission we need to store and process your inputs and outputs to run the service for you. We do not use your content to train AI models.
5. Acceptable use
Don’t use Nilav to create or distribute content that:
- is illegal, or infringes anyone’s copyright, trademark, privacy or other rights;
- impersonates a real person, or presents fabricated events, statements or evidence as real in order to deceive;
- harasses, threatens, or promotes violence, hatred or self-harm;
- sexualises minors, or is sexually explicit;
- is spam, a scam, or misleading advertising, including false claims about products or health;
- breaks the rules of the platform you publish it on, including rules on disclosing AI-generated or altered content.
Don’t try to break, overload, reverse-engineer or get around the limits or security of the service, or resell access to it without our written agreement. We may suspend or close accounts that break these rules; where the breach is serious we may do so without notice or refund.
6. AI output
AI can be wrong. Outputs may contain factual errors, outdated information or content that resembles existing work. Review what Nilav produces before you publish or rely on it; you are responsible for what you publish.
7. Our service and intellectual property
The Nilav software, design, templates and brand belong to us. These terms give you the right to use the service as described, and nothing more.
8. Closing your account
You can delete your account at any time from Settings; this cancels any subscription and removes your content. We may close accounts as set out above, or if we stop offering the service, in which case we will refund the unused part of any prepaid period.
9. Warranties and liability
The service is provided “as is”. We work to keep it available and accurate but do not promise that it will be uninterrupted, error-free or fit for a particular purpose. To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim is limited to the amount you paid us in the three months before it arose. Nothing in these terms limits rights you have under consumer protection law that cannot be excluded.
10. Changes and governing law
We may update these terms. For material changes we will notify you by email or in the app before they take effect; continuing to use Nilav afterwards means you accept them. These terms are governed by the laws of India, and disputes are subject to the jurisdiction of its courts.
